1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between RenoCommand Limited ("RenoCommand", "we", "us", or "our"), a company registered in England and Wales, and you ("User", "you"), regarding your access to and use of the RenoCommand website (renocommand.com) and our software platform (collectively, the "Services").

By creating an account, subscribing, or accessing any part of our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

Service QualityServices must be performed with reasonable care/skill, as described, fit for purpose. Digital content must be of satisfactory quality.

3. The Services

3.1 Free Services

We may offer certain features without charge, including but not limited to: The Library (articles), the Home Page, and the PDR Checker widget.

3.2 Paid Services (Subscription)

Payment of the applicable subscription fee grants access to premium features, including:

  • Project Management: Tools including List views, Kanban Boards, and Gantt Charts.
  • Finance Hub: Budgeting tabs, expense management, and analysis KPIs (e.g., Budget vs. Actual).

3.3 "Talk to an Architect" (Referrals)

The Service may include functionality to connect you with third-party architects. You acknowledge that RenoCommand acts solely as a lead referrer. We do not provide architectural services, nor do we employ these professionals. Any contract for work is strictly between you and the architect. We are not liable for their advice, workmanship, or failure to perform.

4. Accounts, Subscriptions, and Billing

4.1 Contract Formation

A binding contract is formed when you: (1) Place an order for a subscription; (2) Provide valid payment details; and (3) Receive an email confirmation or gain access to the Paid Services.

4.2 Pricing and Payment

  • All prices are quoted in GBP (£) and exclude VAT (we are not currently VAT-registered).
  • Payments are processed securely by our third-party payment processors (Stripe). We do not store your full credit card details.

4.3 Automatic Renewal and Cancellation

  • Renewal: Your subscription will automatically renew at the end of each billing period (monthly or annual) unless cancelled.
  • Cancellation: You may cancel your subscription at any time via your User Profile. Access will continue until the end of the current paid billing cycle. No refunds mid-cycle. Pro-rata refunds only on annual plans if cancelled >14 days before renewal.

4.4 Refund Policy

  • Waiver: By accessing the Paid Services immediately upon purchase, you expressly request the immediate supply of digital content and acknowledge that you lose your right to the statutory 14-day cooling-off period.
  • Faulty Service: Refunds are only provided if the digital content is proven to be faulty or not as described, in accordance with the Consumer Rights Act 2015.

5. Intellectual Property and Content

5.1 Our IP

RenoCommand owns all intellectual property rights in the software, code, algorithms, design, Library content, and branding. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal home renovation projects only (not professional/property development or commercial use).

5.2 Prohibited Conduct

You must not:

  • Copy, modify, reverse-engineer, decompile, distribute, merge, or remove our copyright/trademarks.
  • Share your login credentials with third parties.
  • Use the Service for business or commercial purposes without our express written commercial licence.
  • Scrape, extract, or automatically harvest data from our PDR Checker, Library, or other parts of the Site.

5.3 Your Data (User Generated Content)

You retain ownership of the data you input (e.g., budget figures, project tasks). You grant RenoCommand a worldwide, royalty-free licence to host, store, and process this data solely for the purpose of providing the Service to you and for internal service improvement. Data export available via Profile → Settings. Account closure → data deleted per Privacy Policy (30 days, except tax records).

6. CRITICAL DISCLAIMERS AND LIMITATIONS OF LIABILITY

6.1 No Professional Advice

RenoCommand provides no legal, architectural, planning, engineering, financial, or construction advice. The tools offer general guidance and estimates only.

6.2 Permitted Development Rights (PDR) Disclaimer

PDR guidance is based on publicly available information and is for informational purposes only. It is not exhaustive and not project-specific. You must verify all planning feasibility and compliance with your Local Planning Authority or a qualified planning consultant before starting any work.

6.3 Budgeting Tool Disclaimer

The Finance Hub provides estimates, projections, and guidance only. RenoCommand is not liable for:

  • Actual project costs exceeding your budget.
  • Inaccuracies in estimated costs.
  • Financial or physical losses resulting from decisions based on the tool.

6.4 Services Provided "As Is"

The Services are provided "as is" and "as available" where permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or compatible with all third-party devices.

7. Third-Party Liability & Indemnification

We bear no liability for the performance or actions of any third parties, including referred architects or linked external resources. You agree to indemnify and hold RenoCommand harmless against any claims, losses, or damages arising from your breach of these Terms, your misuse of the Service, or your project decisions.

8. Our Liability

  • Our total liability for any claim arising out of these Terms is capped at the total subscription fees paid by you in the 12 months preceding the date the claim arose.
  • We exclude liability for indirect, special, incidental, or consequential damages, including loss of profits, data, project costs, or delays.
  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.

9. Governing Law & Disputes

  • Governing Law: These Terms and any dispute or claim arising out of them are governed by the laws of England and Wales.
  • Jurisdiction: The English courts have exclusive jurisdiction in relation to these Terms.

10. General Provisions

  • Force Majeure: We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control (e.g., acts of God, war, internet infrastructure failure).
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  • Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
  • Entire Agreement: These Terms constitute the entire agreement between you and RenoCommand regarding the Services.
  • Privacy: Our use of your personal data is governed by our separate Privacy Policy, which is incorporated by reference into these Terms.
